These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Hardwood Evolution, also known as Hardwood Basketball (“Company,” “we,” “us,” or “our”) governing your access to and use of the Hardwood Evolution mobile application, website, services, training programs, content, and related offerings (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms.

1. ELIGIBILITY

You must be at least 13 years of age to use the Platform.

If you are under 18:

  • You may only use the Platform with the consent of a parent or legal guardian
  • Your parent/guardian agrees to be bound by these Terms on your behalf

2. ACCOUNT REGISTRATION & SECURITY

To access certain features, you may be required to create an account.

You agree to:

  • Maintain the confidentiality of login credentials
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts at our sole discretion.

All services are provided for educational and informational purposes only.

4. NO GUARANTEE OF RESULTS

You acknowledge that:

  • Athletic performance varies by individual
  • Results are not guaranteed

Hardwood Evolution makes no representations or warranties regarding:

  • Skill development
  • Performance outcomes
  • Athletic advancement

5. HEALTH DISCLAIMER & MEDICAL LIMITATION

The Platform does not provide medical advice.

You agree that:

  • You are responsible for consulting a physician before beginning any training program
  • You will not use the Platform if you have a condition that makes participation unsafe

6. ASSUMPTION OF RISK & LIABILITY WAIVER

You acknowledge that participation in basketball training and physical activity involves inherent risks, including but not limited to:

  • Sprains, strains, fractures
  • Serious injury or death

To the fullest extent permitted by law, you:

  • Voluntarily assume all risks associated with use of the Platform
  • Release and hold harmless Hardwood Evolution, its owners, officers, employees, contractors, coaches, and affiliates from any and all claims, liabilities, damages, or losses arising out of or related to your participation

If you are a parent or guardian, you agree to this waiver on behalf of your minor.

7. AI & PERFORMANCE ANALYSIS DISCLAIMER

The Platform may provide automated or AI-assisted analysis of user-submitted content.

You acknowledge that:

  • AI-generated feedback is informational and may not be accurate or complete
  • Such analysis should not be relied upon as professional, medical, or guaranteed performance advice

Hardwood Evolution disclaims all liability arising from reliance on AI-generated insights.

8. USER-GENERATED CONTENT & VIDEO SUBMISSIONS

By submitting videos, images, or other content (“User Content”), you grant Hardwood Evolution a:

  • Worldwide
  • Non-exclusive
  • Royalty-free
  • Perpetual license

…to use, reproduce, analyze, distribute, and display such content for:

  • Service delivery
  • Product improvement
  • Marketing and promotional purposes

You represent that:

  • You own or have rights to the content
  • The content does not violate any third-party rights

9. MEDIA RELEASE (PHOTO & VIDEO USE)

By using the Platform and/or submitting content, you grant Hardwood Evolution permission to:

  • Use your likeness, image, voice, and performance
  • Publish such content in marketing, advertising, and promotional materials

10. PAYMENTS, SUBSCRIPTIONS & REFUNDS

  • All fees are listed in USD
  • Subscriptions automatically renew unless canceled prior to the renewal date
  • You authorize us to charge your payment method on file

Refund Policy:

  • Digital products and subscriptions are non-refundable unless otherwise stated
  • Exceptions may be granted at our sole discretion

11. INTELLECTUAL PROPERTY RIGHTS

All Platform content, including:

  • Training systems
  • Drills and methodologies
  • AI models and analysis frameworks
  • Videos, graphics, branding

…are the exclusive property of Hardwood Evolution.

You may not:

  • Copy, distribute, or reproduce content
  • Reverse engineer systems or methodologies
  • Use content for commercial purposes without written consent

12. PROHIBITED CONDUCT

You agree not to:

  • Use the Platform for unlawful purposes
  • Upload harmful, abusive, or infringing content
  • Attempt to disrupt or compromise Platform security
  • Share account access

13. THIRD-PARTY SERVICES

The Platform may integrate with third-party services (e.g., payment processors).

We are not responsible for:

  • Errors or failures caused by third-party systems

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Hardwood Evolution shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Injuries or damages resulting from Platform use

Total liability shall not exceed the amount paid by you to Hardwood Evolution in the preceding 12 months.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Hardwood Evolution from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your User Content

16. TERMINATION

We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms.

17. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Colorado, United States.

Any disputes shall be resolved through:

  • Binding arbitration in Colorado
  • You waive the right to participate in class-action lawsuits

18. CHANGES TO TERMS

We reserve the right to update these Terms at any time.

Continued use of the Platform constitutes acceptance of updated Terms.
